    1. General provisions<\/b><\/p>

    The present General Terms and Conditions (hereinafter referred to as \"GTC\") define the terms and conditions of the use of the Service between the Service Provider and the Customer (hereinafter collectively referred to as \"Contracting Parties\"), as well as the rights and obligations arising between the Contracting Parties.<\/span><\/p>

    The Guest will have a service relationship with the Service Provider for the actual participation in the Service selected by the Guest. The Service Provider's liability in relation to the Service covers the entire booking process, as well as the performance, realisation and possible cancellation of the Service as advertised.<\/span><\/p>

    The reservation of the Service provided by the Service Provider, accessible through the means described on the Website, constitutes a contract between the Service Provider and the Guest for the use and provision of the services under the terms and conditions set out in these GTC. The contract shall be deemed to be a contract concluded between persons who are not present on the Internet, in Hungarian, but not in writing, the content of which can be retrieved and accessed subsequently from the reservation system.<\/span><\/p>

    The agreement between the Parties shall be concluded in the language of the language of the Parties' choice, in case of dispute in Hungarian. Due to the specific nature of the Internet, the territorial scope of these GTC is not limited to the territory of Hungary.<\/span><\/p>

    \u00a0<\/span><\/p>

    2. Adoption and amendment of the GTC<\/b><\/p>

    By making a purchase on the website or by paying the amount related to the booking, the User declares that he\/she has read and accepted the terms and conditions of these GTC and the Policy published on the website and that he\/she has consented to the processing of his\/her data necessary for the use of the Service within the scope specified in the GTC and the Privacy Policy.<\/span><\/p>

    The Service Provider informs the Guest and the Guest expressly acknowledges that the Service Provider is entitled to unilaterally amend the GTC. In the event of any amendment to the GTC, the Service Provider shall notify the Guest by posting the changes on the Website at least eight (8) days prior to the effective date of the amendment.<\/span><\/p>

    3. Guest details<\/b><\/p>

    Only persons over the age of 18 are entitled to reserve the Service described on the Website.<\/span><\/p>

    The Service Provider reserves the right to refuse the Guest's reservation in justified cases, in particular in case of false or incomplete data or any abuse of the Service, the Website or the reservation.<\/span><\/p>

    The Guest declares that the information provided on the booking form is true and correct. The Service Provider shall not be liable for any damage resulting from the provision of incorrect, false or misleading data or e-mail addresses during the registration process, but may claim compensation from the Guest for any damage incurred in this respect. The Service Provider shall be responsible for the performance and invoicing of the service in accordance with the data provided by the Guest. The Guest may check and modify his details at any time, as they will be included in the confirmation of the enquiry sent by the Service Provider on the form. The Service Provider is entitled to delete obviously incorrect or false data and, in case of doubt, to verify the authenticity of the Guest.<\/span><\/p>

    \u00a0<\/span><\/p>

    4. Prices, booking and confirmation<\/b><\/p>

    The Guest can find out about current prices and available services on the website www.spalove.hu. The Service Provider is free to change the advertised prices of the Guest House without prior notice until the payment of the participation fee. The prices quoted on the website are in HUF and include unlimited use of the guest house and its facilities, but not the local tourist tax (IFA).\u00a0<\/span><\/p>

    If the Service Provider, despite all due care, displays an incorrect price on the website, in particular a price of \"0\" Ft or \"1\" Ft that is obviously incorrect, e.g. significantly different from the well-known, generally accepted or estimated price of the service, or a price of \"0\" Ft or \"1\" Ft due to a system error, the Service Provider is not obliged to sell the product at the incorrect price, but may offer to sell it at the correct price, in the knowledge of which the Customer may withdraw from the purchase. A significant difference of at least 50 %, whether positive or negative, from the market value of the product or service in question shall be considered to be a significant difference.<\/span><\/p>

    In the case of incorrect prices to the extent described in the previous point, there is a striking discrepancy between the actual price of the service and the price indicated, which should be immediately apparent to the average consumer. According to Act V of 2013 on the Civil Code (Civil Code), a contract is concluded by mutual and consensual expression of the will of the parties. If the parties cannot agree on the contractual terms, i.e. if there is no mutual and unanimous expression of the will of the parties, the contract is not valid and does not give rise to rights and obligations. On this basis, an order confirmed at an incorrect\/incorrect price shall be considered as a void contract.<\/span><\/p>

    The service contract is concluded upon the Guest's written reservation, payment of the accommodation fee 100% and the Service Provider's written confirmation of the reservation and payment of the accommodation fee. The Guest is obliged to accept the GTC, the House Rules and the Privacy Policy by ticking the appropriate box before sending the booking form. After that, the Guest finalises the request by completing and sending the booking form. In addition to the feedback from the Service Provider, the Guest will receive, after payment of the amount due, an e-mail message confirming payment and confirming the booking to the e-mail address provided by the Guest, containing the details of the Service. The confirmation e-mail confirming the booking and the payment of the fee will be sent by the Service Provider to the e-mail address provided by the Guest. The Applicant shall be liable for any damage resulting from the provision of an incorrect e-mail address.<\/span><\/p>

    Any amendment or addition to the Contract shall require the written agreement of the parties. Once a booking has been finalised and confirmed, it may be possible to reschedule it to another date or to change the number of guests, subject to availability.<\/span><\/p>

    The Service Provider reserves the right to market the Service through accommodation portals. However, the Service Provider draws your attention to the fact that the individual terms and conditions of use of the selling portals are available on their own websites and are outside the responsibility of the Service Provider.<\/span><\/p>

    The Service Provider is entitled to periodically run promotions that provide a discount from the list prices of the Services at a rate it determines. Information on the terms and conditions of these promotions and the beneficiaries will be provided on the website for the duration of the promotion. The Service Provider is also entitled to offer certain discounts only to Guests or a group of Guests specified by the Service Provider and is not obliged to provide information about these discounts on the website.<\/span><\/p>

    \u00a0<\/span><\/p>

    5. Billing<\/b><\/p>

    The Provider of the Service <\/span>an electronic invoice (hereinafter referred to as an e-invoice)<\/span> with the information you provide during the booking process. The data required for the invoice are: name, registered office\/address and, if available, tax number and e-mail address. <\/span>An e-invoice is an invoice that contains the invoice data in the form of electronic symbols. An e-invoice can only be issued, transmitted and stored in electronic form and its paper version cannot be used as an original authentic document. The Service Provider issues the e-invoice on the basis of the data provided by the Customer. By initiating the payment process, the Customer expressly declares that he accepts the e-invoice.<\/span><\/p>

    \u00a0<\/span><\/p>

    6. How and under what conditions to use the Service<\/b><\/p>

    The use of the Service shall be confirmed by the Guest upon the arrival of the <\/span>on the day of the event from 14:00<\/span> (\"check-in\"), while on departure, you can start your stay at the end of the fixed term <\/span>by 10:00 a.m. on the day of the<\/span> to leave the accommodation (\"check-out\"). The \"check in\" and \"check out\" are <\/span>Without the presence of a service provider, as follows:<\/span><\/p>

    The house is equipped with a key safe, and the access code will be sent to the mobile phone number or e-mail address provided at the time of booking by 10 am on the day of arrival. The lock code is active until departure.<\/span><\/p>

    In accordance with the legislation in force, guests staying at the accommodation are responsible for recording their data, the so-called document scanning process. Guests under 14 years of age have to be registered by their legal representative (e.g. parent, guardian).<\/span><\/p>

    Once the reservation has been confirmed by the accommodation provider, the customer will receive an automatically generated e-mail containing the details of the reservation to the e-mail address previously provided by the customer, and the guest will be required to send the details to the accommodation provider for the reservation to be confirmed.\u00a0<\/span><\/p>

    If the Guest is not able to carry out the preliminary guest data recording as described above, the Service Provider or its agent will personally record the Guest's data and verify the identity of the guests provided in the reservation as part of or as a condition of the check-in. In such cases, the arrival time shall be agreed in advance between the Service Provider and the Guest.<\/span><\/p>

    If the document is not presented, the Service Provider will refuse to provide the accommodation.<\/span>. In the event of refusal of service under this clause, the Service Provider reserves the right to claim payment of the cancellation or modification amount set out in clause 10.<\/span><\/p>

    The Service Provider does not allow the accommodation of pets.<\/span><\/p>

    The Guest uses the Service provided by the Service Provider during his\/her entire stay at his\/her own risk.<\/span><\/p>

    The Service Provider is entitled to terminate the service contract with immediate effect, or refuse to provide the service, if:<\/span><\/p>

    • the Guest does not use and\/or damages the accommodation provided to him\/her for the purpose for which it was provided; the Guest disturbs or obstructs the Service Provider's operations and does not cease such behaviour despite the Service Provider's request;<\/span><\/li>
    • the Guest fails to comply with the Service Provider's security requirements;<\/span><\/li>
    • the Guest engages in threatening, abusive or other blatantly anti-community behaviour;<\/span><\/li>
    • the Guest is contagious or suffers from a disease that interferes with the operation of the Service Provider.<\/span><\/li>
    • the Guest is also responsible for all other persons travelling or resting with him\/her who breach the above conditions of participation. The Service Provider is not obliged to clarify the identity of the person who actually caused the damage during the booking.<\/span><\/li><\/ul>

      If the Guest or the persons staying with him\/her are found to have caused damage during the Service or if there is reasonable doubt as to the proper use of the Service, the Service Provider may remove the Guest and the persons staying with him\/her from the Service at the same time as the Service is interrupted. In the event of exclusion for such a reason, the Service Provider shall not be liable to pay any compensation or to reimburse the Service fee in whole or in part.<\/span><\/p>

      If, as a result of war, riot, terrorist act, strike, accident, fire, blockade, flood, natural disaster, health crisis, serious energy supply disruption or any other unforeseeable and unavoidable obstacle beyond the control of the Guest or the Service Provider, one of them is unable to fulfil a contractual obligation, that person shall not be liable for any loss or damage caused by these events.<\/span><\/p>

      7. Rights and obligations of the Guest<\/b><\/p>

      Rights of the Guest<\/span><\/p>

      • The Guest is entitled to use the Accommodation for its intended purpose within the scope of the Services,<\/span><\/li>
      • The guest is entitled to use the equipment and facilities of the accommodation.<\/span><\/li>
      • In the event of any problem during your stay, you can contact the service provider by phone on the website or in writing at info@palovs.hu to resolve the problem as soon as possible.<\/span><\/li><\/ul>

        Obligations of the Guest<\/span><\/p>

        • The guest is obliged to compensate the service provider for any damage caused by the guest. If the guest house cannot be rented out due to the repair or elimination of the damage, the guest is also obliged to compensate the loss of income for this period.<\/span><\/li>
        • No corrosive, flammable, combustible, explosive or explosive substances, fireworks, firecrackers, their parts, components, waste, environmentally harmful, harmful to health or psychotropic substances may be brought into the guesthouse area. If the guest brings any unauthorised material or equipment onto the premises of the guest house without the prior written permission of the operator, the operator may remove or have removed at the guest's expense. The operator excludes liability for any damage caused in this connection, but the guests are jointly and severally liable for any damage or injury caused in the building or to other guests, third parties or the operator.<\/span><\/li>
        • Guests are jointly and severally liable for any damage caused by their own electrical appliances, and the guest is responsible for any damage caused.<\/span><\/li>
        • Any incident - personal injury, fire, chemical incident, accidental damage to equipment or objects - must be reported immediately to the operator or his representative, who must take immediate action.<\/span><\/li><\/ul>

          8. Rights and obligations of the Service Provider<\/b><\/p>

          Rights of the Service Provider<\/span><\/p>

          The Service Provider shall be entitled to retain the amount of the accommodation costs received for the accommodation service ordered and finalised by the Guest but not used by the Guest, as set out in these GTC and in the Booking and Cancellation Conditions.<\/span><\/p>

          Liability of the Service Provider<\/span><\/p>

          • The Service Provider is obliged to investigate the guest's complaint during the stay and take the necessary steps to solve the problem.<\/span><\/li>
          • The Service Provider is obliged to provide the Guest with his\/her telephone contact details in order to resolve any problems or questions that may arise during the stay.<\/span><\/li>
          • The Service Provider is not responsible for any electrical equipment brought in by the guest, and the guest is responsible for any damage caused by the equipment.<\/span><\/li>
          • The Service Provider shall not be liable for damage caused by the guest himself or for damage caused by the guest's own fault or for damage beyond the control of the guest. The Service Provider shall not be liable for any damage caused by force majeure, force majeure or any other cause or event beyond the control of the Service Provider, for which the Service Provider cannot be held liable.<\/span><\/li>
          • The Service Provider is not responsible for any personal belongings, valuables, cash left in the parking space in front of the back, in the garden or in the house.<\/span><\/li>
          • The Service Provider shall provide the Service to the Guest on an ongoing basis against payment of the Guest's payment obligation.<\/span><\/li>
          • The Service Provider shall store the Customer's data for the purpose of fulfilling the contract and for the purpose of proving the terms of the contract, but shall not be entitled to pass them on for advertising or any other purpose without the Customer's express consent.<\/span><\/li>
          • Handling of guest reports and complaints: the Guest may report any errors detected in connection with the above service to the Service Provider in person, by telephone, or by e-mail at info@spalove.hu. The Service Provider shall investigate the reports and complaints within 30 days and shall inform the Guest of the results of the investigation in accordance with the method of reporting.<\/span><\/li><\/ul>

            \u00a0<\/span><\/p>

            9. Cancellation, modification, termination and refund<\/b><\/p>

            The Guest undertakes to inform the Service Provider in writing of any cancellation, modification or any other change to the reservation made by the Guest prior to the start of the service. <\/span>Before arrival min. Reservations cancelled within 15 days of arrival will be refunded in full.<\/span><\/p>

            If cancellation is made within 14 days of arrival, the full amount will be charged.<\/span><\/p>

            You can change your appointment once up to 15 days before arrival. If the Guest decides, before the expiry of the booked and paid period of the Service started, that he\/she no longer wishes to use the Service provided by the Service Provider - i.e. he\/she interrupts the use of the Service - or does not arrive at the time of arrival, but has not cancelled the Service in accordance with the conditions set out in these GTC, he\/she shall pay the full price of the Service to the Service Provider, and the Service Provider shall be entitled to make the Service available and bookable for another Guest for the period not used by the Guest.<\/span><\/p>

            If the Guest decides to use the Service provided by the Service Provider for a longer period before the expiry of the booked and paid period of the Service, this shall be considered as a modification of the order, which the Guest shall notify the Service Provider no later than the day before the expiry of the booked period, and the Guest shall pay the Service Provider the amount of the order. In the event of written confirmation by the Service Provider, a written amendment to the service contract shall be deemed to have been concluded between the parties. The amendment of the service contract shall be concluded only by written agreement of the Contracting Parties.<\/span><\/p>

            \u00a0<\/span><\/p>

            10. Changing or cancelled Service<\/b><\/p>

            If, for any reason, the date of the Service is changed or the Service is cancelled after the booking has been finalised, for any reason in the Supplier's interest, the Supplier shall, except in cases of force majeure as referred to in point 7, notify the Guest at the latest 14 days before the start of the Service, who may, at his option, request a refund of the amount paid or its inclusion in the price of the Service booked or available for booking on another date. The Service Provider shall make all reasonable efforts to inform the Guest as soon as possible and accurately in the event of any modification\/cancellation of the Service and to facilitate the refund\/recovery of the Service fee. The Service Provider reserves the right to set individually agreed termination conditions for bookings of its Services subject to special conditions, in particular special offers.<\/span><\/p>

            \u00a0<\/span><\/p>

            11. Gift voucher<\/b><\/p>

            In addition to operating the booking system, the Service Provider shall make available on its website gift vouchers (hereinafter referred to as \"Gift Vouchers\") that can be purchased in various denominations of a value determined in advance by the Service Provider. The Gift Vouchers are issued primarily electronically and, upon request, are delivered on a personalised paper form by post. The Gift Vouchers are cash substitutes and cannot be converted into cash, and therefore, if redeemed for a Service of lesser value, the remaining amount will be lost. The face value of the Gift Vouchers is the same as the amount indicated on the relevant Gift Voucher. The date booked with a Gift Voucher cannot be cancelled, a single date change is possible up to 15 days prior to arrival. Gift vouchers may be redeemed and used up to 12 months from the date of purchase. The use of a gift voucher must be notified to the Supplier at the time of booking. Multiple Gift Vouchers may be used for a single booking, but a single Gift Voucher may only be used once. The Gift Voucher is freely transferable to anyone, the holder is deemed to be the person who uses the Gift Voucher and the Service Provider does not verify the legality of the use.<\/span><\/p>

            The content of the Gift Voucher includes the following: the details of the Service Provider as the issuer, the reference to the Gift Voucher, the issue value, the period of use, a unique serial number.<\/span><\/p>

            By purchasing a Gift Voucher, the Guest agrees to be bound by the rules for the issuance and use of the Gift Voucher set forth in these GTC.<\/span><\/p>

            \u00a0<\/span><\/p>

            12. Limits to the Service Provider's Service<\/b><\/p>

            The Guest acknowledges that due to the characteristics of the Internet, the continuous operation of the Website may be interrupted despite the prior knowledge and intention of the Service Provider, and errors may occur. Accordingly, the Service Provider does not guarantee the error-free and uninterrupted operation of the Service and the related website, or uninterrupted or error-free access to the Service. The Service Provider may suspend the Service, in whole or in part, for maintenance of the Service or the related website or for other security reasons, without any prior notice or information. The Service Provider shall only be liable for damages caused by intentional or grossly negligent errors for which it is responsible. The extent of liability shall not exceed the value of the purchase transaction. The Guest acknowledges that the Service Provider shall not be liable for any damage or misuse of any kind arising during or as a result of payment by credit card. The Service Provider excludes any liability for any damage caused by the Customer or any third party's breach of contract or unlawful act or omission.<\/span><\/p>

            14. Data protection<\/b><\/p>

            15. Complaints handling procedure<\/b><\/p>

            If the User has a complaint about the contract or its performance, he\/she may also communicate it by telephone, e-mail or letter to the address published on the website.<\/span><\/p>

            The Service Provider will investigate the oral complaint immediately and remedy it as necessary. If the Guest does not agree with the handling of the complaint or if it is not possible to investigate the complaint immediately, the Service Provider shall take a record of the complaint and its position on the complaint and shall provide the Guest with a copy of the record.<\/span><\/p>

            The Service Provider will reply to the written complaint in writing within 30 days. The reasons for rejecting the complaint shall be given.<\/span><\/p>

            If the Guest's complaint is rejected, he\/she may bring the complaint before an official or conciliation body, as follows:<\/span><\/p>

            • The Consumer may lodge a complaint with the consumer protection authority:<\/span><\/li>
            • In the event of a complaint, the Consumer has the right to apply to a conciliation body, the contact details of which can be found at www.bekeltetes.hu.<\/span><\/li>
            • The conciliation body is responsible for settling consumer disputes out of court. The conciliation body's task is to attempt to reach an agreement between the parties to resolve the consumer dispute and, if this is unsuccessful, to rule on the case in order to ensure that consumer rights are enforced in a simple, quick, efficient and cost-effective manner. At the request of the consumer or the Supplier, the conciliation body shall advise the consumer on the rights and obligations of the consumer.<\/span><\/li><\/ul>

              \u00a0<\/span><\/p>

              16. Copyright<\/b><\/p>

              After the <\/span>https:\/\/palovs.hu<\/b>, as a website constitutes a copyright work, it is prohibited to download (reproduce), retransmit to the public, otherwise use, electronically store, process and sell the content of the website or any part thereof without the written consent of the Service Provider.<\/span><\/p>

              Even with written consent, any material from the website and its database may only be reproduced by linking to that website.<\/span><\/p>

              \u00a0<\/span><\/p>

              17. Final provisions<\/b><\/p>

              The Contracting Parties undertake that in the performance of their obligations arising from the contract concluded on the basis of these GTC, they shall act in compliance with the applicable legal provisions, in good faith and in accordance with the requirements of fairness and honesty, and shall mutually cooperate with each other, informing each other of all relevant circumstances affecting each other without undue delay. The Service Provider shall be bound by the provisions of these GTC and the information published on its website and shall in any case act in accordance with what is generally expected in the given situation. In the exercise of the rights and obligations arising from the service contract between the parties resulting from their acceptance of these GTC, each party shall act with due regard for the legitimate interests of the other party. Furthermore, the Contracting Party and the Customer shall act in the performance of the contract in such a way that the good reputation of the Service Provider is not damaged or endangered. The Contracting Parties shall communicate with each other in writing by e-mail in the first instance in respect of all matters arising in connection with the provision of the service. If the e-mail address of the Contracting Parties changes in the meantime, they shall inform each other thereof without delay. The present GTCF is written in Hungarian, the interpretation of which shall be governed by the rules of Hungarian law, and in the case of issues not regulated by the relevant provisions of Act V of 2013 on the Civil Code, Act CVIII of 2001 on certain issues of electronic commerce services, information society services and other relevant legal provisions shall apply.<\/span><\/p>

              These GTC were adopted on 09.02.2024 and entered into force on the same date.<\/span><\/p>
